A Utah dog owner has been left heartbroken after her pet was shot and killed moments after it ran away from her in a city with strict leashing laws.

was walking her dog ruby in Roy’s West Park when she lost control of the animal.

The German Shepherd-mix bounded up to a man and his service dog who said Ruby was acting aggressively.

Police said he yelled at Isturis-Gramly to get her dog, before firing a fatal shot at Ruby. 

They said the dog killer’s behavior was perfectly legal and that Isturis-Gramly was at fault.

‘It doesn’t feel real right now,’ she told KSL. ‘It didn’t seem like an appropriate response at a park in a walking area where everyone is trafficking and usually with dogs.

‘She’s a sweet dog. She didn’t deserve this.’

Her mom Ingrid Isturis agreed that Ruby was not acting aggressively during the incident on Tuesday.

‘Ruby just got away,’ She added. ‘She’s a friendly dog. She got away, ran towards the other dog.

‘She was just being friendly, wagging her tail, excited. From that moment on, pop.’ 

They also said they did not hear any warning from the man before he shot Ruby.

‘He didn’t warn us as owners,’ Isturis-Gramly said. ‘He said, ‘Leave it.’ He didn’t even give a pause long enough for her to respond to that. And she was just standing there.’ 

But police took a different view, stating that the man was well within his rights to act as he did.

‘In Roy city, it is a crime to have your dog off leash or not secured, running at large, especially if they’re aggressive and attacking other people or other animals,’ Roy Police Sgt. Josh Taylor said.

‘People are allowed to defend themselves, and defend their animals as well. If there is an aggressive dog then you are well within your right to do so.’ 

In Roy, dog owners who allow their pets off-leash in public spaces or private residence’s without the owners’ permission can be fined up to $100 per violation.

‘I have dogs as well. You want to go out, exercise your dogs, take them off the leash, but you have to understand that sometimes dogs, with other dogs, are unpredictable,’ Taylor added.

‘And the important thing is just make sure you’re keeping your dogs on leash. That way you can secure them if anything does happen.’
